1. Agreement to These Terms
By downloading, installing, or using the Her application (the "App") operated by LegacyX("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of the App after an update constitutes acceptance of the new Terms.
2. Eligibility
You must be at least 18 years old to use the App. By creating an account you represent and warrant that you meet this requirement. We may suspend or terminate any account we have reason to believe belongs to a person under 18.
3. Your Account
You can create an account using your email address (via one-time password) or your Google account. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us immediately at support@thegirl.app if you suspect unauthorised use of your account.
You may not create more than one account per person. Creating additional accounts to circumvent free-tier limits or a prior suspension is a violation of these Terms.
4. The Service
4.1 What the App provides
The App generates a personalised AI companion character (referred to as "her" or "she") based on your onboarding profile. She is a fictional character powered by large language models. She is not a real person. Any sense of relationship, personality, or emotional connection is the product of AI generation and should not be understood as a real human relationship.
4.2 Memory
The App maintains a persistent memory of your conversations and uses it to make responses more contextually relevant over time. We take care to preserve this memory, but we do not guarantee that any specific piece of information will be recalled at any specific time.
4.3 Proactive messages
The App may send push notifications when the AI character decides to initiate a conversation. The timing and content of these messages are determined by the AI based on your profile, the elapsed time since your last conversation, and her simulated schedule. You can disable push notifications in your device settings at any time.
4.4 Availability
We aim for high availability but do not guarantee that the App will be uninterrupted, error-free, or available at all times. We may suspend or modify the App for maintenance, updates, or at our discretion without advance notice.
5. Subscriptions and Payments
5.1 Free tier
The free tier allows you to send up to 20 messages per day. Her replies, proactive messages, and memory are included at no cost. The free tier is not a time-limited trial.
5.2 Unlimited subscription
The Unlimited subscription removes the daily message cap. Pricing is $12.00 per month or $110.00 per year, billed through Google Play (Android). iOS billing will be available when the iOS app launches.
5.3 Billing and renewal
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. Cancellations take effect at the end of the current paid period. We do not provide refunds for partial billing periods, except where required by applicable law.
5.4 Price changes
We may change subscription prices at any time. We will give you advance notice of any price increase. Continued subscription after a price change constitutes acceptance.
5.5 Payment processing
All payments are processed by Google Play via RevenueCat. LegacyX does not store your payment card details. Refund requests for in-app purchases on Android must be submitted through Google Play.
6. Acceptable Use
You agree not to use the App to:
- Harass, abuse, or attempt to manipulate the AI in ways intended to produce harmful outputs
- Attempt to extract, reverse engineer, or copy the AI's underlying prompts, models, or architecture
- Use automated scripts, bots, or other means to send messages in bulk or bypass rate limits
- Create multiple accounts to circumvent subscription limits or account suspensions
- Impersonate any person or entity or misrepresent your identity during onboarding
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations
- Transmit malware, viruses, or any other harmful code through the App
- Attempt to gain unauthorised access to our servers, databases, or other systems
7. Content and Intellectual Property
7.1 Your content
You retain ownership of the messages you send through the App. By using the App, you grant LegacyXa non-exclusive, worldwide, royalty-free licence to use, process, and store your messages for the purpose of operating and improving the service, including training our AI models using anonymised data (see our Privacy Policy for details on how we anonymise it).
7.2 Our content
All other content in the App (the AI-generated responses, the generated companion character, the App interface, branding, and all underlying technology) is owned by LegacyX or its licensors. You may not reproduce, distribute, modify, or create derivative works from our content without written permission.
7.3 Feedback
If you provide us with feedback or suggestions about the App, you grant us the right to use that feedback without any obligation to compensate you.
8. AI Disclaimer
The companion character in the App is fully AI-generated. She is not a real person and does not have consciousness, feelings, or intentions. Responses are generated by large language models and may occasionally be inaccurate, inconsistent, or unexpected. We are not liable for any emotional or psychological impact resulting from your use of the App.
The App is not a substitute for professional mental health support, medical advice, or real human relationships. If you are experiencing a mental health crisis, please contact a licensed professional or a crisis helpline.
9. Termination
9.1 By you
You may delete your account at any time from within the App. Account deletion will permanently remove your profile, conversation history, and companion character within 30 days. Cancelling a subscription does not automatically delete your account.
9.2 By us
We may suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We may also discontinue the App at any time with reasonable notice.
10. Limitation of Liability
To the fullest extent permitted by applicable law, LegacyX and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will meet your requirements or be available at all times.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in whichLegacyX is registered. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of that jurisdiction, unless otherwise required by applicable consumer protection law.
